Tamara works in a company in a department of a warehouse. Her job involves lifting heavy items .For now, Tamara is pregnant and can’t allow her to do her daily activities such as lifting the items as usual. In addition, Tamara has got no qualifications to work in any other department. In my opinion ,with relevant reasons, the company should give Tamara work off until she deliver .In regards to law protecting pregnant employees(Pregnancy discrimination Act of 1978) and family and medical leave act , Tamara is entitled to get back to job when her leave is over. She must be offered the same job or equivalent one when she returns.

Whatsoever, it is not acceptable for an employer to reprimand an employees from taking Family Medical Leave due to pregnancy (Shinall, 2020).For example, if Tamara is allowed to take a leave, the company should not count her leave as unexcused absence under the attendance policy. Additionally, If Tamara is willing or is planning to take leave due to her pregnancy, she must give the company notice at least 30 days in advance. The company will give her some notices on FMLA and some forms to complete. THE COMPANY will be checking in with Tamara periodically about her intent to return to work.

In regard to CIPD, 2018 on benefits for women on pregnancy leave of maternity leave, every woman is entitled to Statutory Maternity Pay (SMP).They are entitled to be paid 90 per cent of their salaries  for the first 6 weeks of their leave, Therefore ,the company should pay Tamara Statutory Maternity Pay (SMP) until she resumes to her work.
